Spousal support isn't automatic in New Jersey

Many people going through divorce wonder how the process unfolds in New Jersey. The simple answer is that what happens in your divorce depends primarily on the individual circumstances. Some divorces have alimony as a component, but others won't.

In New Jersey, there is no set formula for spousal support. Instead, there are 14 factors that the court might consider when determining whether to set alimony payments. One of the most commonly used is the length of the marriage. The longer the marriage, the more likely it is that one party will receive alimony.

Other factors include:

  • The need of one party to receive the payments
  • The ability of the other party to pay
  • The mental and physical health of both parties
  • The marital standard of living and the ability to maintain it
  • The earning capacity for each person
  • The length of time one party was out of the workforce
  • The reason for the absence from the workforce

Typically, spousal support is associated with high-asset divorces. In many cases, one party was a stay-at-home parent or spouse. In these cases, there might be some job training or education that must occur for that person to re-enter the workforce.

The goal of the court is to ensure that both parties have an equal lifestyle after the divorce. This is an expensive state, so there might be some concessions that must be made when the marriage ends.
