Wrongful death suit seeks $2.3M after elderly victim's fatal fall

When residents of New Jersey need assistance in caring for elderly loves ones, they often have no choice but to trust that whatever facility they choose is a safe environment staffed with compassionate and well-trained professionals. Tragically, this is sometimes not the case, and helpless senior citizens are the ones who pay a high price through physical pain and suffering or, sometimes, even their lives. In another state, a wrongful death lawsuit filed by a deceased individual's estate accuses the facility in which he was staying of negligence that directly led to his death.

According to the lawsuit, the 99-year-old man had an established, lengthy history of balance problems, decreased muscle coordination and falls. Because of this, nursing staff were supposed to assist him when he needed to move from place to place. Additionally, a bed alarm and alarmed floor mats were supposed to be in place. Despite all these safeguards that were supposed to be in place, the man suffered a serious fall that turned out to be fatal.

Per reports, nursing staff discovered the elderly individual lying in the fetal position on the floor in the early hours of March 18, 2017. The patient was complaining of head pain and had suffered a three-inch gash to his elbow. Initially, staff did not even notice his severe hip injury; it was not discovered until later that his left hip was displaced. The patient died a little over two weeks later, reportedly from complications involving this hip fracture.

The nursing home and its employees stand accused of negligence for a number of failures, including failing to properly assess the patient's fall risk, failing to adequately supervise and care for the individual and more. The wrongful death Claim seeks $1.5 million for the man's pain and suffering, as well as additional damages for funeral and medical expenses and more. Anyone in New Jersey who has likewise endured the loss of an elderly loved one due to a nursing facility's negligence may wish to explore legal options with an attorney in the Morristown area who has experience in cases of a similar nature.
