Medical malpractice: Arrest warrant issued after abuse claim

People in New Jersey who spend a large portion of their days caring for elderly people must have a great deal of patience and compassion. Regardless of the stress that can come with such a job, all those who provide such care must treat their patients with the care and respect they deserve. If the appropriate standard of care is not provided, filing a medical malpractice lawsuit may become necessary.

A 90-year-old woman in another state may be considering such an action after she claims she was abused. According to her report, the patient believes that a 44-year-old nursing assistant became angry when the patient notified her that she had wet the bed. The patient claims that she was forced onto her stomach and was struck multiple times on her back. She was also allegedly berated for wearing "too many pull ups."

She informed other staff about the alleged incident the next day. After she reported difficulty walking, she was transported to the hospital. An arrest warrant has since been issued for the worker; she faces a felony charge as a result of the incident. The patient now claims that she is afraid to return to the nursing home facility.

Patients in nursing home facilities should feel safe while in such a setting while also receiving the necessary and appropriate care. When medical malpractice in the form of abuse occurs, patients and their families often choose to pursue damages in a civil court.
