Car accidents involving children are especially heartbreaking

Car crashes happen almost every day in New Jersey as the state's residents and visitors travel its streets and highways. Some of these car accidents involve fatalities and/or serious injuries, and most people can sympathize with the victims and their families. However, the accidents that pull at nearly everyone's heartstrings are the ones involving children whose lives end before they truly even have a chance to begin.

As she did most school mornings, a grandmother was driving six of her grandchildren to school at approximately 7:20 a.m. The minivan occupied by the family was heading south through an intersection. What happened next is still being investigated, but witnesses believe that the driver of an eastbound vehicle failed to obey a stop sign and collided with the minivan.

Emergency responders were forced to remove the roof of the minivan in order to get everyone out of it. Five of the six children survived, but a 10-year-old girl's lifeless body was removed from the minivan. All of the children were taken to the hospital to be examined and treated for a variety of injuries -- some of which were minor, thankfully. At last report, the children's grandmother remained hospitalized in stable condition.

Police are working to determine whether the driver in the other vehicle did, in fact, run the stop sign. New Jersey residents who live around the intersection report that it is dangerous and needs more stop signs. After this crash, police reported that additional stop signs are being considered.

The family of the deceased girl -- and any other seriously injured children -- and the grandmother retain the right to file civil actions against the party or parties who caused and/or contributed to the crash. Not only would the driver of the car be included, but perhaps the governmental body or bodies responsible for the safety of the intersection would be named as defendants as well since it is possible that it is unsafe. If the victim's family proves negligence, a New Jersey court may award damages. Just as important is the possibility that the intersection may be made safer so that the potential for car accidents is reduced.
