Legal remedies for nursing homes treatment mistakes, abuse

Regardless of how careful family members are when choosing a New Jersey nursing home for a loved one, no guarantee can be given that he or she will not suffer an injury at the hands of the staff. Treatment mistakes happen, and the party or parties deemed responsible may face claims for financial responsibility for the consequences of those mistakes. Sometimes, however, the behavior of staff crosses from a mistake into abuse.

Back in 1976, The Bill of Rights for New Jersey Nursing Home Residents was passed. Certain responsibilities on the part of nursing homes were established, along with important rights for every resident of a nursing home in our state. Injuries to nursing home residents can be caused in any number of ways, including falls, bed sores or dehydration and/or malnutrition.

These injuries are often the result of negligence and/or abuse. Still other residents are the victims of either physical or emotional abuse. If any of these situations arises, ensuring the safety of your loved one is the first priority.

New Jersey authorities -- including law enforcement officials in some cases -- may be called in to investigate the conditions that led to the injury. While officials conduct their investigations, it may be beneficial to employ the services of an attorney familiar with elder abuse cases. These tragedies can lead to a multitude of unexpected expenses.

When a loved one residing in a nursing home is injured, it is imperative to first determine whether treatment mistakes were made, or if the patient was the victim of something worse, such as nursing home abuse. This may be helpful in determining the next course of action that is appropriate to the circumstances. In any case, a civil action against the nursing home and any other parties believed responsible for your loved one's injuries or death may be filed. A successful claim could result in financial restitution and the knowledge that others may be safer because you came forward.
